You are responsible for safeguarding your password and for any activities or actions under your account.

4. User Responsibilities and Conduct

You are solely responsible for the photos you upload ("User Content"). You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to your User Content. You agree not to upload User Content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware.

You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the service.

5. Intellectual Property Rights

Your Content: You retain all ownership rights to the original photos you upload. By uploading photos, you grant Telefoto AI a limited, worldwide, non-exclusive, royalty-free license solely to use, reproduce, modify, and process the photos to provide the headshot generation service to you. As detailed in our Privacy Policy, original uploaded photos are automatically deleted according to our data retention schedule.

Generated Headshots: Subject to your compliance with these Terms and payment of any applicable fees, Telefoto AI grants you a perpetual, non-exclusive, worldwide, royalty-free license to use the headshots generated by the Service for personal and commercial purposes.

Our Service: The Service itself, including its software, look and feel, branding, and underlying technology, is the property of Telefoto AI and its licensors and is protected by copyright, trademark, and other laws.

6. Payment and Fees

Certain aspects of the Service may require payment. You agree to pay all applicable fees as described on the Service for the plan you select. All fees are non-refundable. We use a third-party payment processor (Stripe) to handle payments. Please review their terms and privacy policy.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. Information regarding the handling and deletion of your data upon termination is outlined in our Privacy Policy.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TELEFOTO AI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

AI-generated content can sometimes be unpredictable or contain inaccuracies. We do not guarantee the quality, accuracy, or suitability of the generated headshots for any specific purpose.

9. Limitation of Liability

IN NO EVENT SHALL TELEFOTO AI, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

These Terms shall be governed and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict of law provisions.
